ENHANCEMENTS AND OTHER “COLLATERAL” CONSEQUENCES TO CRIMINAL ALLEGATIONS:

Many people do not realize there are “collateral”, or indirect consequences of criminal allegations in Texas. For example, enhanced drivers license suspension periods of up to two years can occur in subsequent Administrative License Revocation proceedings (ALR) involving a prior alcohol contact.

Individuals with a commercial driver’s license can be subject to longer suspension periods in alcohol related suspensions even if they were not in a commercial vehicle at the time of the arrest. Depending upon the offense charged, there may even be a “hard” suspension period during which the licensee is ineligible for an “Essential Needs” or “Occupational Drivers License”. The same may be true for individuals convicted of drug offenses. Subsequent allegations of DWI may be enhanced, with additional and more severe penal and other collateral consequences.

More severe punishments may arise as a direct result of prior criminal occurrences. For example, a subsequent allegation of Assault – Family Violence may be enhanced from a Class “A” misdemeanor to a third degree felony grade offense. Additionally, a collateral consequence of such a conviction for Assault – Family Violence is a restriction on the individual’s ability to possess and purchase weapons.

Two prior theft convictions can enhance a third offense, regardless of the amount alleged, to a felony grade offense. So, for example, if an individual has been twice convicted of theft and is accused of shoplifting a $2.00 candy bar from a convenience store, that individual may be prosecuted for a felony grade offense.

Other, more direct enhancement consequences increasing ranges of potential punishment are available in subsequent prosecutions. It is important to know how they could potentially apply, even to the first time offender.
